ATSUM objects to GoM’s 2016 Office Memorandum

The All Tribal Students Union Manipur (ATSUM) said today that it took strong exception to the Office Memorandum (OM) published in the Manipur Gazette by the Department of Personnel & Administrative Reforms, Government of Manipur “wherein it has directed all government departments to adopt the OM of Ministry of Personnel, Public Grievances and Pension, Department of Personnel and Training OM No. 36012/11/2016-Estt.(Res.) dated 30th September, 2016 for all services/posts under the State Government of Manipur, including societies, agencies, undertakings, companies, corporations, etc..”

According to the ATSUM, the said Office Memorandum which invited reference to DoPTOM of 2016 is in contravention of the Supreme Court Order on 17.05.2018 in the SLP (C) No. 30621/2011 and DoPT OM dated 15.06.2018. The apex tribal student body of the state further said that The OM issued by Special Secretary (DP) Government of Manipur implies that promotions of reserved category persons to unreserved posts can no longer be allowed. “This totally negates the status quo being followed in matters of departmental promotion of all government employees where candidates from reserved category are adjusted in unreserved category on the basis of own merit and seniority,” the ATSUM added.

The tribal student union then said that the Supreme Court Order on 17.05.2018 on matter of reservation in promotion treatment of SC/ST candidates promoted on their own merit, directed that “the pendency of this Special Leave Petition shall not stand in the way of non of India taking steps for the purpose of promotion from ‘reserved to reserved’ and ‘unreserved to unreserved’ and also in the matter of promotion on merits.” Accordingly, DoP&T promulgated the order vide DoP&T’s OM dated 15.06.2018 and the same has been adopted ever since, the ATSUM added.

“Instead of adopting the DoP&T’s OM dated 15.06.2018 which takes precedence over earlier OMs the state government chooses to adopt DoP&T’s OM dated 30.07.2016. This can be construed as a malicious intent to deprive deserving ST employees of their due promotions against the unreserved vacancies. ATSUM cannot remain a silent spectator if this misdemeanour against the tribal employees of the state is not stopped,” the ATSUM said. Therefore, the ATSUM said that the concerned authority should rectify the OM by adopting the DoP&T’s OM dated 17.05.2018 and further refrain from indulging in any policy having detrimental effect on the wellbeing of the tribal people.
